HIPAA & Security 2 Minute Read

Two weeks from yesterday is the deadline for compliance with the new Omnibus HIPAA rule. As of September 23rd, healthcare providers and their business associates must comply with numerous new privacy and security requirements. There are hefty federal penalties, plus major public and community relations risks, if violations occur.

Penalty structure for HIPAA violations

Omnibus HIPAA implements a number of provisions to strengthen the privacy and security protections for health information. The final rule is an amendment to the original HIPAA Privacy, Security, Breach Notification and Enforcement rules.

The provisions include:

  • New liabilities for Business Associates
  • New liabilities for Subcontractors
  • New and expanded patient rights
  • Changes to PHI disclosure for fundraising purposes
  • Changes to breach notification framework

If you’re unsure about your compliance status or are looking to educate your staff and/or business associates on the new requirements, we have Omnibus HIPAA educational resources. Access two of our published resources below >>
